I Am Tripping My Elephant Here
Once upon a time, a weenie ant was walking on his way. As he was walking, suddenly he felt the ground shaking terribly. He looked around with his paranoid eyes and saw an elephant walking right behind him. Quickly, the little ant covered himself with dirt, but one leg was unfortunately left out. A sparrow saw everything, so she flew down with the purpose of teasing the ant: “Hey, chicken! Watch out your leg, it’s out!” The ant felt embarrassed at first but then calmly responded: “ Shi…I am going to trip that elephant.”
Right now, I’m standing on this glamorous stage. But everything here reminds me of is a not so fun memory. Around this time last year I was in Nanjing competing in another speech contest. That was the first time for me to be in such a large event. Of course the pressure I was under was immense too. After a sleepless and stressful night, I went onto that stage without the feeling in my legs. That speech turned out to be horrible. I don’t remember how I get down from there, but I do remember afterwards I just wanted to find a hole to hide in just like the ant in the story. 按照《食品安全法》和食品安全监管体制调整的要求，自6月起xx县食药监局承担了餐饮服务环节食品安全监管职能，面对新的监管领域和新的职能，如何保证餐饮服务环节食品安全是我部门面对的一项新课题。我局在加强自身学习的基础上，把调查研究当作真抓实干、开拓创新的“问路石”，集中利用了一个月的时间，采取摸底调查、重点抽查、座谈走访、典型分析等方式方法，深入企业、深入基层对全县餐饮单位的食品安全状况进行了专题调查研究，初步掌握了餐饮服务行业具体经营情况和存在的问题，汇总分析形成了调查报告。
一、基本情况概述
xx县辖区面积约2540平方公里，总人口57万，辖28个乡镇（处），469个行政村，农村人口约47万，由于社会经济发展相对比较落后，全县尤其是农村、边远山区的餐饮服务业整体水平较低。据不完全统计，目前全县有固定店面的餐饮总数为862家，其中有许可证的为560家，无许可证的为302家，即将转让的为13家，获证率约为64。9%。在所有餐饮单位中大型企业18家，中型企业15家，学校食堂40家，农家游199家，绝大部分为小型餐饮单位，占全县餐饮单位总数的96%。从数据统计来看，我县餐饮单位基本呈金字塔状，塔顶端的大、中型餐饮单位数量最少，中间部分为较为规范的小型餐饮单位，最底端则是数量庞大的`流动性强、从业人员不稳定、设施设备缺乏、自我管理水平低下的“五小”（小餐馆、小吃店、小饮品店、小农家乐、小食堂）餐饮单位。
二、存在的主要问题及原因分析
（一）数量众多、布局分散，无证经营现象突出。随着城镇化的发展，生产生活节奏日益加快，对方便快捷的就餐需求越来越大，餐饮服务形式也呈现多样化发展，除较规范的酒店外，绝大多数是家常风味店、特色小吃店、休闲餐厅、烧烤店、大排档、农家乐等，而这些小型餐饮单位常常抱着“省钱经营”的心态去经营，投入少、成本低、分布广、条件差，加之多数业主法律意识不强，存在事先不申请，不管卫生条件符合与否，不经许可即行开办的现象，有的企业则是被查处时才被迫办证，（）不查不办，更有甚者是遇到检查，听到风声不对，干脆“收兵回营”，躲过检查后再继续经营，导致我辖区内存在着一大批未办证的餐饮单位。
（二）从业人员文化素质低，健康体检不到位。目前，我县餐饮业的从业人员，尤其是中小型企业的从业人员，多数是低文化层次的群体，其中初中、高中文化的居多，部分从业人员甚至连最基本的法律法规和起码的卫生知识都一无所知，大多是凭着自己的经验操作；有的企业不为从业人员办理健康证明，或者为了应付办证，节省体检费用，从业人员体检几个就算了事，不符合全员体检的规定，加上从业人员流动性大，体检了的走了，新来的未经体检随即上岗，特别是无《餐饮服务许可证》的经营企业，从业人员全部未进行健康检查，若有患有传染性疾病（如甲肝、肺结核等）的人员上岗，给消费者构成严重的健康隐患，这些患病从业人员成为餐饮业的“隐形杀手”。
（三）设施设备简陋，经营条件不符合要求。众多的小餐饮单位受自身经营规模、方式和经济条件的限制，业主不愿意在硬件设施上投入，难以做到分间操作，有的甚至生熟案不分，也不能达到远离厕所、粪堆、污水沟等污染源的要求。日常监督检查时经常见到库房、操作间的物品就地堆放或堆放无序，废菜乱扔，污水横流的现象，较为脏、乱、差。特别是夜市、小吃摊点、火锅店等大多数集中在交通便利、人口密集的地段，来往车辆多，卫生环境条件极差，加之自带的清水和餐具有限，但是需要洗刷的餐具、用具又多，为了节约用水，两盆水撑到底，一盆去油，一盆冲刷，更别提卫生消毒了，存在许多食品安全隐患。
（四）小餐桌、小食堂管理缺失。据不完全统计，我县中小学校食堂办理《餐饮服务许可证》还比较到位，但是机关企事业单位、建筑工地食堂获证率较低，学生小饭桌的获证率极低，这些小食堂、小餐桌未获许可，基础条件差，操作规程混乱，餐饮具消毒空白，责任管理缺失，对其监管难度也很大，几乎处于脱管游离状态。
（五）监管力量不足，制约监管工作有效开展。随着监管体制的调整，餐饮消费环节由我局负责，同时我局还承担着药品、医疗器械、保健食品、化妆品的监管职责，而我县餐饮业存在点多、面广、线长的特点，执法装备尤其是仅有的3台执法车辆远远不能适应新任务的监管需要，存在着“力不从心”的困境，而我局在乡镇村又没有派出机构，与数量众多而监管难度大的餐饮单位形成了悬殊鲜明的对比。
（六）检验检测技术手段不到位。《食品安全法》实施后，食品药品监管部门开展餐饮食品检验检测将实行“买样制”，检测设备、抽样费和检验费将面临巨大缺口，这将成为制约餐饮服务食品安全监管的重要因素。还有，餐饮服务监管职能交由食品药品监管部门，但检验检测工作仍由疾控中心承担，餐饮监管与检测检验两者能否有效对接，能否协调运转都值得商榷探讨。
（七）农家游、农家乐监管工作是一个棘手问题。我县是一个旅游大县，大力发展农家游、农家乐对于加快推进社会主义新农村建设、拓宽农民增收渠道具有十分重要的意义。但是，旅游本身具有人员高度集中、特殊时令性、区域特色性等特点，尤其是xx月中旬至xx月中旬较兴旺，农家游、农家乐在这一季节也逐步成为餐饮服务食品安全的高风险场所，主要表现在：许多经营者在未取得《餐饮服务许可证》情况下对外开放经营，从业人员普遍存在无证上岗现象；开办者大部分是地处偏远山区的农村人口，法律意识、卫生意识相对较差；厨房功能布局不合理，功能间缺少，卫生设施不全，xx造成交叉污染，部分经营户为体现“农家乐”“家常便饭”的意图，在食品操作加工上采用不卫生的“土方法”；部分经营户不配备或者虽配备了餐具消毒、保洁设施，有的不经常使用、有的由于游客数量多不能满足实际需要，形同虚设；前几年，我县为发展农家游、农家乐专门制定了相应的管理规范和许可条件，但随着旅游业的日益发展，旅游人数日渐增多，饮食花样日益繁多，原有的许可条件和规范远不能符合满足现实的监管情况。
三、建议与对策
（一）强化宣传教育，提高消费者自我保护意识和经营者守法意识。充分利用广播、电视、上街咨询、手机短信、投诉举报等形式，多渠道、多方位地宣传餐饮服务食品安全法律、法规及饮食卫生知识，增强广大人民群众的饮食安全意识和自我保护能力，xx月份，利用一周时间，我局通过召开餐饮环节食品安全宣传周启动大会，公开发放执法服装、设置展台、接受咨询，组织人大代表、政协委员参观优秀餐饮服务单位、开展“五进”活动和餐饮服务执法检查开放日活动，营造餐饮服务食品安全监管工作的良好社会氛围，对此项工作进行了积极有益的探索；要加强对餐饮业从业人员特别是专职或者兼职食品安全管理人员的培训力度，定期对其进行《食品行业从业规范》、《食品生产经营操作规程》等知识的培训学习，提高从业人员规范管理、守法经营的自觉性，扎实开展从业人员年度体检工作，对患有传染性疾病的人员要采取强制措施，调离其直接接触食品的岗位，xx月xx日，由市局统一安排，组织全县380名餐饮服务单位食品安全管理人员，进行了食品安全知识培训。
（二）加强监督执法力度。对申领许可证的企业就其现场布局、设施设备、人员条件等项目进行实地核查验收，严格把好市场准入关，对不符合准入条件的坚决予以取缔，目前，我局已受理餐饮服务经营企业申请书31份，已发放餐饮服务许可证20件；
对辖区内餐饮企业落实采购食品及食品原料索证索票、进货查验和台账记录制度执行情况进行专项监督检查，确保一旦发生事故能够追根溯源，xx月份我局印制了统一的台账登记册，发放到餐饮企业，同时完善了23项餐饮食品安全制度，指导餐饮企业健全餐饮食品安全各项规章制度，并装裱上墙张贴在相应功能区；重点开展餐饮服务食品安全专项整治工作。根据省市食品药品监管局食品安全专项整治工作要求，严厉查处餐饮单位无证经营和采购、使用病死或者死因不明的畜禽及其制品、劣质食用油以及非法添加等违法行为。
（三）加强政策引导。积极研究制定“五小”餐饮企业管理办法，借鉴重庆市小餐饮临时许可办法，对加工经营场所面积在60平方米以下或者就餐座位在30座以下的小餐馆、小吃店、小饮品店、小农家乐、小食堂等符合餐饮服务“即时制作、即时消费”基本特征的餐饮服务提供者办理6—8个月的《餐饮服务临时许可证》，既使临时性企业得到规范，又不至于浪费资源，符合小型企业流动性大、季节性强的特点。xx月份，我局在对全县餐饮企业摸底调研的基础上，突出监管重点，将社会关注度高的学校食堂、农家院、农村集体聚餐及经营规模小xx出问题的餐饮服务摊点、小餐饮列为重点规范对象，经过上下反复酝酿、广泛征求意见、反复修改，拟定了《xx县学校食堂食品安全监督管理规范》、《xx县餐饮服务摊点监督管理办法》、《xx县农家宴席监督管理规范》、《xx县农家院监督管理办法》《xx县小餐饮临时许可审查规范》，已上报县政府，目前处于审核阶段；
（四）全面推进餐饮业信用体系建设。保定市食品药品监督管理局制定了《餐饮去服务环节食品安全量化分级管理实施方案》，根据该方案将餐饮企业划分为A、B、C三个等级，有利于促进餐饮服务经营者提高自身食品安全信用等级，提高餐饮服务食品安全水平，我局在具体工作中将坚持“监管并重、量化评价动态监管、公开透明”的原则进行量化分级；除此之外还将开展餐饮服务食品安全监管示范试点工作。通过制定标准、广泛发动、积极参与等形式评选出10名餐饮示范企业，充分发挥示范店（学校）的引领带动和辐射作用，全面推动我县餐饮服务食品安全监管工作上新台阶，同时主动曝光一批无证经营、无证上岗、卫生条件不符合要求且屡教不改的企业或摊主，使违法经营者无容身之地。
